1. Agreement to Terms
By accessing or using PointsMagic's website (pointsmagic.com) and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. These Terms constitute a legally binding agreement between you and PointsMagic.
2. Description of Services
PointsMagic is a travel points concierge service. We provide expert research, routing analysis, and booking guidance to help clients maximize the value of their credit card points and airline miles for premium travel. Our services include:
Award Flight Booking — $200
Per traveler, per roundtrip
- Expert research and routing across 19+ airline partners
- Identification of optimal award availability, including partner inventory and "ghost" availability
- Step-by-step booking guidance or hands-on booking assistance
- Comprehensive audit of your points balances across programs (Chase, Amex, Capital One, Bilt, etc.)
Award Hotel Stays — $100
Per destination
- Research of best bookable award hotel options across loyalty programs
- Suite upgrade strategies and elite benefit optimization
- Access to FHR (Fine Hotels & Resorts), Virtuoso, and Travel Leaders / Internova partner perks
Strategy Sessions — $300
Per 1-on-1 session
- Personalized credit card spend strategy and planning
- Comprehensive point audit and valuation across all your programs
- Long-term earn-and-burn planning to maximize your points over time
3. No-Results-No-Charge Guarantee
PointsMagic stands behind our work with a straightforward guarantee:
If we are unable to find a viable award booking option that meets your stated travel requirements, you will not be charged our service fee.
- This guarantee applies to Award Flight Booking and Award Hotel Stay services
- "Viable option" means an available award booking that reasonably matches your requested destination, dates (within a flexible window discussed during consultation), and cabin class
- The guarantee does not cover situations where the client declines all presented options, changes requirements after research is completed, or fails to provide accurate points balance information
- Strategy Sessions are non-refundable as the value is delivered through the consultation itself
- Refunds under this guarantee are processed within 5–10 business days
4. User Responsibilities
By using our services, you agree to:
- Provide accurate information. You must provide truthful and complete information about your loyalty program memberships, points balances, travel preferences, and personal details. Inaccurate information may result in suboptimal recommendations or inability to complete bookings.
- Maintain account security. You are responsible for the security of your own loyalty program accounts, login credentials, and personal information. PointsMagic will never ask for your loyalty program passwords.
- Respond in a timely manner. Award availability is dynamic and time-sensitive. You must respond promptly to booking options presented by our concierges. PointsMagic is not responsible for availability changes that occur due to delayed client responses.
- Comply with program rules. You are responsible for complying with the terms and conditions of your loyalty programs and credit card issuers. PointsMagic does not encourage or facilitate violations of any program's terms of service.
- Pay service fees promptly. Service fees are due upon engagement or as otherwise agreed. Failure to pay may result in suspension or termination of services.
- Use services lawfully. You agree not to use our services for any unlawful purpose or in violation of any applicable laws or regulations.
5. Payment Terms
- All prices are in US Dollars (USD)
- Service fees are charged per engagement as described in Section 2
- Payment is required before or at the time research begins, subject to the No-Results-No-Charge Guarantee
- PointsMagic's service fees are separate from any taxes, fees, or surcharges associated with award bookings themselves (such as fuel surcharges, airport taxes, or carrier-imposed fees)
- We accept major credit cards and electronic payment methods
6. Nature of Services
PointsMagic acts as a concierge and advisory service. We are not a travel agency, airline, hotel, or loyalty program operator. Important clarifications:
- We provide research, recommendations, and guidance — the actual booking is executed through the relevant airline or hotel loyalty program
- Award availability, pricing, transfer ratios, and program rules are controlled by third-party loyalty programs and are subject to change without notice
- We are not responsible for changes made by airlines, hotels, or loyalty programs after a booking is completed (including schedule changes, cancellations, or devaluations)
- Our Travel Leaders / Internova partnership provides additional perks on select bookings but is subject to partner availability
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- No consequential damages. PointsMagic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of points or miles, loss of travel opportunities, or loss of data, regardless of the cause of action or theory of liability.
- Maximum liability cap. Our total aggregate liability for any claims arising from or related to our services shall not exceed the total service fees paid by you to PointsMagic in the twelve (12) months preceding the claim.
- Third-party actions. We are not liable for actions, omissions, or policy changes by airlines, hotels, credit card issuers, loyalty programs, or other third parties that affect your travel plans or points balances.
- Points and miles. PointsMagic is not responsible for the loss, expiration, devaluation, or forfeiture of your points and miles, whether or not related to our recommendations.
- No warranty. Our services are provided "as is" and "as available." We make no warranties, express or implied, regarding the availability of specific award inventory, the accuracy of points valuations, or guaranteed savings amounts. Past results and case studies are illustrative and do not guarantee future outcomes.
8. Intellectual Property
All content on the PointsMagic website — including text, graphics, logos, design elements, and proprietary research methodologies — is the property of PointsMagic and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.
9. Termination
Either party may terminate the service relationship at any time. If you terminate before research is delivered, refund eligibility will be assessed based on the stage of work completed. PointsMagic reserves the right to refuse or terminate service to any client who violates these Terms, provides fraudulent information, or engages in abusive conduct toward our team.
10. Dispute Resolution
Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation. If a resolution cannot be reached within 30 days, either party may pursue binding arbitration under the rules of the American Arbitration Association. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
11. Modifications
PointsMagic reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
